These terms of use do not apply to your use of unaffiliated Sites to which any of the Sites may link to or direct you to.

The contents of our Sites are protected by copyright and trademark laws, and are the property of their owners. All information herein on the Sites is copyrighted by Seconde Nimenya, the Owner. Unless otherwise noted, you may access and use the information and materials within the Sites for your personal use, but you may not change, modify, delete, display, transmit, adapt, exploit, or copy for distribution or sale of any information, material, trademark, or copyright on the Sites. You must obtain written permission from us or any other entity who owns intellectual property on the Sites before you may publish, distribute, display, or commercially exploit any material from the Sites. By using the Sites, you agree to abide by all copyright notices or other posted restrictions.

These terms of use apply only to our Sites, and not to the Sites of any other companies, organizations, or entity including those we link to. We do not maintain, create, endorse, or take any responsibility for the contents, advertising, products or other materials made available through any other site, including those we link to. Under no circumstance will we be held responsible or liable, directly or indirectly, for any loss or damage that is caused or alleged to have been caused to you in connection with your use of any content, goods or services available on any other site. Events Information and Speaker Schedule Changes

The events and information listed on our Sites are subject to change without notification. We also reserve the right to cancel an event, if there is no significant attendance that justifies the cost of putting the event together; in such rare cases, we will reimburse your full pre-paid tuition fee for the portion of the event we cancel. If your tuition fee includes receiving any product (example a book), you will have the opportunity to choose to receive the product (s) and be reimbursed on the portion of the event canceled (example the live workshop or seminar, whether online or off line).

Submissions

We welcome your comments about any of the Sites. However, we will not review or consider any unsolicited creative submissions or suggestions for topics at our seminars or within our newsletters or products and services. We hope you will understand that this policy is intended to avoid the possibility of future misunderstandings in the event that ideas developed by our team might seem to be similar to the ideas submitted to us. Accordingly, we must ask that you not send us any original creative ideas, suggestions or materials unless you accept these conditions of use. If, despite our request, you send us any idea, suggestion or material (“Submission”), it shall become our property. We will not be subject to any obligation of confidence for any Submission, and we will not be liable for any use or disclosure of any Submission. In the case that you submit something to us and it is unsolicited, we will exclusively own all rights to the Submission worldwide, and we will be entitled to the unrestricted use of the Submission for any purpose, without compensation or notification to the provider of the Submission. Given this fact, we ask that you refrain from submitting creative projects to us, particularly those that are confidential or personal to you.

Forums/Online Meetings/Chat Rooms

A “forum” means any message board, chat room, user review forum or other interactive service appearing on any of our Sites and includes both public boards and private folders. You must register in accordance with instructions that you will find on the Sites in order to contribute to any forum. You may not post on any forum, or send to any other forum user or our team, any material that is abusive, vulgar, threatening, harassing, libelous, defamatory, obscene, invades a person’s privacy, violates any intellectual or other property rights, or that would otherwise violate any law. We disclaim all warranties, guaranties, expressed or implied, including but not limited to implied effectiveness of the ideas, or success strategies listed on all our Sites as well as those that are provided in our products, programs and or services, to the participants at our events online or offline. Neither we, nor any of our respective licensors or suppliers warrant that any functions contained in the Sites will be uninterrupted or error-free, that defects will be corrected, or that the Sites or the server that makes them available are free of viruses or other harmful components. Neither we, nor any of our respective licensors or suppliers warrant or make any representations regarding the use or the results of the use of the services, products, programs, information or materials on our sites in terms of their correctness, accuracy, reliability, or otherwise. You (and not we, or any of our respective licensors or suppliers) assume the entire cost of all necessary servicing, repair or correction to your system. We do not endorse, warrant or guarantee any speakers, products or services offered on our Sites, or those we link to. We are not a party to, and do not monitor any transaction between users and third party providers of products or services.

Limitation of Liability

Under no circumstances, including but not limited to negligence, will we or any of our licensors or suppliers be liable for any special or consequential damages that result from the use of, or the inability to use the materials or information on our Sites, or any products or services provided pursuant to the Sites, even if advised of the possibility of such damages. Under no circumstances will we be held responsible or liable, directly or indirectly, for any loss or damage that is caused or alleged to have been caused to you in connection with your use of any advice, goods or services you receive from a guest expert on our Sites or at our events.

We are also not responsible or liable for any loss or damage that is caused or alleged to have been caused to our guest speakers/experts in connection with the display of their photo, name, or biography posted on our Sites or in our marketing materials.

We Do Not Offer Professional Advice

The information contained in or made available through our Sites (including but not limited to information contained on message boards, in text files, video files, blogs, reports or in chats, social networks profiles and timelines and shares) cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, financial, medical, psychological, or legal matters. Earnings/Financial Disclaimer

Our products, programs and or services are intended to help you find your passion and purpose in life, by giving you the tools to choose the life you want to live and the legacy you want to leave; but these products, programs and or services demand work and discipline just like any worthwhile endeavor or professional continuing education program. We do not offer any money for you to make products, programs and or services, only we offer such products, programs and or services for personal growth and development. As stipulated by law, we cannot and do not make any guarantees about your ability to get results or earn any money with our ideas, information, tools or strategies. Because the results are on an individual basis and are up to the person. We just want to help by giving great content, direction, and strategies. We will however give you a 48 hours cancellation time from the purchase time for any pre-paid products, programs and or services to receive 100% of your money before you receive the products, programs and or services you pre-paid for. After 48 hours, we will charge accordingly, and at full price, unless you can prove that the reason for your returns or cancelations is due to damage or defect in our programs, products and or services not elsewhere covered in these Terms and Conditions. You accept to pay all applicable fees incurred by any returns or cancelations of the products, programs and or services. You should know that all products, programs and or services by our company (or companies) are for educational and informational purposes only. Nothing on this page, any of our websites, or any of our content or curriculum is a promise or guarantee of results or future earnings, or any results other than your choice to achieve personal growth and development, and we do not offer any legal, medical, tax or other professional advice. Any information referenced here, or on any of our sites, is illustrative of concepts only and should not be considered exact promises for actual or future results or money earnings. If you register for a seminar or a workshop, or any event presentation, live or offline, buy a product or service, or contacting us via our site contact form, information is used to reserve your seat, to track your preferences, and to keep you informed about our products, programs and or services and other events. As a visitor to our Sites, you can engage in many activities without providing any personal information. In connection with other activities, such as utilizing the registration for a seminar or participating in a contest, signing up for our newsletter, or our book events, we may ask you to provide certain information about yourself by filling out and submitting an online contact form. It is completely optional for you to engage in these activities. But if you elect to engage in these activities, however, we may ask that you provide us personal information, such as your first and last name, mailing address (including ZIP code or postal code), e-mail address, telephone, credit card information, if needed to purchase a product, program and or service, and other personal information. If you do not provide the data that is required with respect to a particular activity, you will not be able to engage in that activity or purchase that product, program and or service. You agree that any action at law that arises out of, or relates to these terms and conditions of use will be subject to mediation in the State of Washington. If any of these terms of use are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms of use, and will not affect the validity and enforceability of the remaining provisions. TERMS, DISCLAIMERS AND CONDITIONS FOR ALL OUR  EVENTS/PROGRAMS/PRODUCTS/SERVICES

Please carefully read the following terms and conditions relating to your participation in any of the events or seminars which are conducted by our company, or its Promoter, and its Owner. These terms and conditions are relevant to all our company, BECHANGE GROUP which encompasses the business activities and puts together the events and seminars including but not limited to Live Workshops, Live Web or Tele-Seminars, Online or on Site Coaching events, Speaking events, Leadership Workshops, Seminars, Retreats, Mentorship, Newsletters, Blogs, Podcasts, and for any future product, program and or service not mentioned in these terms of use or this site. For the purposes of these Terms and Conditions site, and since we will host one event at a time, all events, seminars and workshops will be herein referred to as the “Event or event (s).”
By registering for the Event at any one of our locations, physical, example “Hotels”, and “Restaurants” or virtual, example “Websites” Webinar, Skype, and other registration hosts, you (the “Attendee”) here accept the obligations stipulated in these terms and conditions.

Attendee Conduct

Seconde Nimenya, the Owner of BECHANGE GROUP, and or its Promoters require all Attendees to be respectful and professional to our team, location hosts, speakers, and other attendees and their guests or families throughout the Event, even during non-scheduled downtime and breaks. Seconde Nimenya, and BECHANGE GROUP or its Promoters reserve the right to ask Attendee and/or their guests to leave the event room immediately should they be deemed rude, uncooperative, unprofessional, intoxicated or in possession of alcohol or any illegal substance, or in possession of any weapon. In such case, the Attendee’s tuition/fees for the Event will not be reimbursed under any circumstances and they will not receive any future products, services or correspondence from Seconde Nimenya, BECHANGE GROUP or its Promoters. Attendee will also not receive any of our advertised bonuses or discounts or qualify for our satisfaction guarantee or any other written or implied guarantee.

Liability Waiver

While we take every possible measure to ensure Attendee safety at the Event, we cannot control everything. For this reason, Attendee is legally responsible for their safety and behavior and agrees to, and is held legally liable to the following statements:
I, the willing Attendee of the Event, hereby accept all risk to my health and of my injury or death that may result from participating in the Event and I hereby release BECHANGE GROUP and its Promoters, its owner Seconde Nimenya, and their officers, employees, interns, contractors, sponsors and representatives from any and all liability to me, my personal representatives, estate, heirs, next of kin, and assigns for any and all claims and causes of action for loss of or damage to my property and for any and all illness or injury to my person, including my death, that may result from or occur during my participation at the Event, whether caused by negligence of BECHANGE GROUP, and or its Promoters, its governing board, officers, employees, or representatives, or otherwise. I further agree to indemnify and hold harmless BECHANGE GROUP, its Promoters, its owner Seconde Nimenya and any third-party company from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while attending and participating in the Event. Under no circumstances will BECHANGE GROUP, its Promoters or its owner Seconde Nimenya or their representatives, helpers, volunteers be held liable for my injury or death or any loss or damage of my personal belongings resulting from my participation in the Event online, or offline. Should I require emergency medical treatment as a result of accident or illness arising during my attendance and participation in the Event, I consent to such treatment. I acknowledge and I agree to be financially responsible for my medical or legal bills that may be incurred as a result of emergency medical treatment. I will notify BECHANGE GROUP, its Promoters, and its owner, Seconde Nimenya, in writing if I am at any time injured prior to, during, or after the Event in my travels or attendance, or if I have medical conditions about which emergency medical personnel should be informed. However, I understand that BECHANGE GROUP, its Promoters and or its Owner Seconde Nimenya, is not legally or otherwise obligated to act on that information in any way, or to providing any medical service whatsoever to me. I agree that if I have any medical or psychological conditions that may hamper me from fully and healthfully participating in the Event that I will notify BECHANGE GROUPs, its Promoters and its Owner, Seconde Nimenya, and that they retain the right to ask that I not participate in portions of or the entirety of the Event.

Liability Disclaimer: No Professional Advice

The information contained in or made available by BECHANGE GROUP, its Promoters, and its Owner Seconde Nimenya, or any third-party through the Event or their websites or services cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, mental, financial, medical, psychological, or legal fields. BECHANGE GROUP, its Promoters, and its Owner Seconde Nimenya do not offer any professional, medical, financial or legal advice and none of the information contained in the Event should be confused with such advice. Neither BECHANGE GROUP, its Promoters, and its Owner Seconde Nimenya, nor their representatives, sponsors, speakers, partners, contractors or any of their affiliates will be liable for any direct, indirect, consequential, special, exemplary or other damages to the Attendee or the Attendee’s business, including economic loss, that may result from participation in our events or from the use of, or the inability to use the materials, information, or strategies communicated through the Event or any products or services provided pursuant to the Event, even if advised of the possibility of such damages. Under no circumstances, including but not limited to negligence, will BECHANGE GROUP, its Promoters, and its Owner Seconde Nimenya be liable for any special or consequential damages that result from Attendee’s participation in the Event. You, the Attendee, alone are responsible and accountable for your decisions, actions and results in life, and by your participation in our Events, you agree not to attempt to hold BECHANGE GROUP, its Promoters, and its Owner Seconde Nimenya, liable for any decisions, actions or results that you make or experience in business or in life due to your participation in the Event (s) at any time, under any circumstance.

Confidentiality and Non-Compete

Attendee hereby understands that the tools, processes, strategies, materials and information presented in the Event are confidential, copyrighted, and proprietary to BECHANGE GROUP, and its Owner Seconde Nimenya, and agrees not to record, duplicate, distribute, summarize, teach or train from the Event materials in any manner whatsoever without the expressed written permission of Seconde Nimenya, the Owner. Any unauthorized use or distribution of these proprietary concepts, materials, and intellectual property by you or your representatives is prohibited and BECHANGE GROUP, its Promoters, and its Owner Seconde Nimenya will pursue legal action for full compensation for the damages, if these terms are violated in order to protect our rights.

Youth Policy and Adult Language/Content

Children under the age of 18 are not allowed to attend, and teens between 13-17 years old can attend, but must have written permission by a parent or guardian throughout authorizing them to attend the entire Event. During our Event, we may discuss adult topics relating to personal and professional growth, but no profanity allowed.

Audio/Visual Rules and Release
Attendees may not, under any circumstance, use any type of recording device to capture the information provided at the Event. No recording devices, photography or videography is allowed in the Event room unless requested and permitted in advance by BECHANGE GROUP, its Promoter, and its Owner, Seconde Nimenya.

By participating in the Event, Attendee understands that the Event that’s live may be recorded in video and audio and/or captured in still and/or digital photographs by BECHANGE GROUP, its Promoter, and its Owner, Seconde Nimenya. Attendee agrees that BECHANGE GROUP, its Promoter, its Owner, Seconde Nimenya, and its representatives have the right and permission to use such recordings and photographs should they include Attendee’s name, likeness, voice, biographical details, testimonial, or photograph for promoting, marketing, advertising or any other purpose in any media or format, online and/or offline, now or hereafter without further compensation, permission, or notification to the Attendee. Attendee understands and agrees that all recordings from BECHANGE GROUP, its Promoter, and its Owner, Seconde Nimenya’s events are the exclusive rights of BECHANGE GROUP and its Owner, Seconde Nimenya.

Therefore, Attendee does not and will not ask for, or expect compensation for the use of recordings or photographs in which Attendee appears or speaks. BECHANGE GROUP, its Owner Seconde Nimenya own all rights of any audio, video, and/or photograph captured during the Event or at any of BECHANGE GROUP and its Owner Seconde Nimenya’s other events.

Privacy Policy and Terms of Use

By visiting our event sites and participating in the Event, Attendees acknowledges and agrees that they are subject to the Privacy Policies and Terms of Use of BECHANGE GROUP and its Owner Seconde Nimenya, which are listed at: https://www.secondenimenya.com

Cancelation Policy

In the case of a cancelation to attend an event, we incur significant administration expenses. Given this fact, we do not accept cancelations or issue refunds beginning 48 hours (2 days) after Attendee has registered for the Event. If Attendees cancel within 2 days of registering they will receive a full refund, but any Attendee seeking to cancel their registration after 2 days will not, under any circumstances, receive a refund. Therefore, as a caution, please register only if you are certain that you will attend the Event. If for whatever reason you are unable to attend the event after you have registered and after 2 days have passed since registering, we will happily transfer your ticket money to someone else you designate or allow you to attend a future event of the same price. Should any other event cost more than you paid, you will be responsible to cover the balance before attending that future event.

Exceptions to the above Cancelation Policy

Although this is rare, we reserve the right to cancel an event at our discretion, and in this case, we will reimburse your full pre-paid tuition for the portion of the event we cancel. If your tuition includes receiving any product (s) – (example a book), you will have the opportunity to choose to receive the product (s) and be reimbursed on the portion of the event canceled (example the live workshop or seminar, whether online or offline), or receive your full tuition for the product(s) and the event, provided that we haven’t shipped your product (s). We do not reimburse for product(s) that have already been shipped to customers (Attendees).

Travel to Event Site

You the “Attendee” will be responsible to cover your own travel expenses to the live events location. Such expenses could be transportation, food (except what is specifically included in the event cost), lodging, etc. Any amenities included in the ticket price will be specified in the event’s announcement. Our Two days (2 days) refund policy is designed to prevent attendees from booking any transportation or lodging before they are certain of attending the event. That is why after two days, we will not reimburse your event ticket, and we are not responsible for any booked transportation of any kind or lodging expenses that is a result of you canceling your attendance to the event for any reason under any circumstance. Please note that any statements of dissatisfaction or requests for refunds during or after the event will not be reimbursed under any circumstances.

Review and Jurisdiction

These Terms will be governed by and construed in accordance with the laws of the State of Washington.  Attendee agrees that any dispute that arises out of or relates to these Terms will be resolved via a non-binding mediation in the State of Washington via a professional mediator obtained by a BECHANGE GROUP Representative. If a successful mediation is not reached, then the issue will move to a binding arbitration arbitrated in the State of Washington in accordance with the policies set forth by the American Arbitration Association. If any of these Terms of Use are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms of use, and will not affect the validity and enforceability of the remaining provisions.
